1. De actie wordt georganiseerd door C&A Mode GmbH & Co. KG (hierna “C&A”), gevestigd aan Wanheimer Straße 70, 40468 Düsseldorf, btw-nummer DE 121280555. Op deze actie zijn uitsluitend deze voorwaarden van toepassing.
2. Deelnemers kunnen een Bose-hoofdtelefoon winnen. De waarde van de prijs bedraagt ca. EUR 260,-.
3. De minimumleeftijd voor deelname is 18 jaar op de sluitingsdatum. C&A behoudt zich het recht voor om personen naar eigen inzicht van deelname uit te sluiten indien daar gegronde redenen voor zijn, bijv. (a) in geval van manipulatie in verband met toegang tot of deelname aan de actie, (b) in geval van overtreding van deze deelnamevoorwaarden, (c) in geval van onjuiste of misleidende informatie in verband met deelname aan de actie.
4. De actie begint op 09 april 2026 en eindigt op 29 april 2026 om 23:59 uur CET. Om deel te nemen dienen deelnemers een foto van zichzelf te maken in een C&A-denimlook of de in de C&A Mirror Room gemaakte video te gebruiken. De foto of video moet in de feed (niet als story) worden geplaatst op het openbare Instagram- en/of TikTok-account van de deelnemer. Het bericht moet de hashtag #MadeForMoves bevatten en zowel in de content als in de caption @ca taggen. Deelnemers dienen C&A gedurende de looptijd van de actie te volgen op het/de voor deelname gebruikte sociale-mediaplatform(en). Alleen inzendingen via openbare socialemediaprofielen die aan deze vereisten voldoen, komen in aanmerking. De winnaar(s) worden door een jury geselecteerd op basis van de beste outfit en beweging.
Deelname is uitsluitend mogelijk binnen de deelnameperiode van de betreffende actie. Deelname na de sluitingsdatum wordt niet in aanmerking genomen. Het is strikt verboden meerdere e-mailadressen of meerdere Instagram- en/of TikTok-profielen te gebruiken om de winkans te vergroten. Deelname is gratis, met uitzondering van eventuele telecommunicatiekosten die door de deelnemer moeten worden gedragen.
5. De winnaar wordt via de commentaarfunctie van Instagram/TikTok op de hoogte gesteld en dient de prijs binnen 5 dagen na kennisgeving schriftelijk te aanvaarden, bijvoorbeeld via een direct message aan C&A. Indien een winnaar niet binnen deze termijn reageert, vervalt het recht op de prijs en zal C&A de prijs opnieuw verloten.
6. De prijs wordt uitsluitend aan de winnaar toegekend. Omruiling, afhaling door de winnaar of uitbetaling in contanten is niet toegestaan. Gedeeltelijke uitbetaling in contanten is eveneens uitgesloten. Eventuele verzendkosten van de prijs worden door C&A gedragen. Het risico van beschadiging en onopzettelijk verlies gaat over op de winnaar op het moment van verzending.
7. Voor zover wettelijk toegestaan sluit C&A iedere aansprakelijkheid uit voor technische storingen en elektronische gegevensoverdracht die het eindresultaat van de actie of deelname daaraan beïnvloeden, alsmede voor aanspraken in verband met de afhandeling van de uitgekeerde prijzen. De aansprakelijkheid van C&A, haar samenwerkingspartners en de door hen ingeschakelde personen voor de uitvoering van de actie en de uitbetaling en verstrekking van de prijs is beperkt tot gevallen waarin wezenlijke contractuele verplichtingen zijn geschonden waarop de deelnemer in het bijzonder mocht vertrouwen (zogenoemde kernverplichtingen). De aansprakelijkheid is beperkt tot de voorzienbare schade die typisch is voor de overeenkomst. Deze aansprakelijkheidsuitsluiting geldt niet in geval van opzet, grove nalatigheid of kwade trouw, noch bij letsel aan personen, garanties of aanspraken op grond van de Productaansprakelijkheidswet.
8. C&A behoudt zich het recht voor om de actie geheel of gedeeltelijk op elk moment te beëindigen, ook zonder voorafgaande kennisgeving. Dit geldt in het bijzonder indien een correcte uitvoering om technische (bijv. manipulatie) of juridische redenen (bijv. verbod door Facebook) niet kan worden gegarandeerd.
9. Door deelname aan de actie bevestigen deelnemers dat zij de deelnamevoorwaarden hebben gelezen en aanvaard en dat zij instemmen met het gebruik van hun persoonsgegevens (volledige naam, adres, e-mailadres, foto, telefoonnummer, geboortedatum) uitsluitend ten behoeve van de uitvoering van de actie en de verzending van de prijs.

C&A verwerkt de persoonsgegevens van de deelnemers op basis van een contractuele noodzaak en voor de uitvoering van de actie, onder meer om vast te stellen of de deelnemer gerechtigd is deel te nemen en om de winnaar(s) vast te stellen en te informeren. Indien de deelnemer deze gegevens niet verstrekt, is deelname aan de actie of contact met C&A inzake een prijsuitreiking niet mogelijk. De verwerking van persoonsgegevens vindt rechtmatig plaats op grond van de Algemene Verordening Gegevensbescherming (AVG), met name ter uitvoering van een overeenkomst en ter behartiging van onze gerechtvaardigde belangen in de veiligheid en integriteit van onze systemen en de verdediging tegen aanspraken in verband met de registratiepagina en prijzen – zie artikel 6, lid 1, onder b) en f) AVG.
Na vaststelling van de winnaar worden de in het kader van de actie verwerkte persoonsgegevens binnen 90 dagen verwijderd.
In beginsel worden de gegevens niet aan derden verstrekt, tenzij dit noodzakelijk is voor de uitvoering van de actie, de verzending van de prijs of de organisatie en uitvoering van een reis en er een gegevensbeschermingsrechtelijke grondslag voor overdracht bestaat. De gegevens worden in dat geval verwerkt door ingeschakelde dienstverleners in het kader van verwerkersovereenkomsten conform artikel 28 AVG.
Overeenkomstig de AVG hebben deelnemers het recht om inzage te verzoeken in hun persoonsgegevens, alsmede rectificatie, verwijdering of beperking van de verwerking daarvan te verlangen. Tevens hebben zij recht op gegevensoverdraagbaarheid. Wij zullen uiterlijk binnen één maand op dergelijke verzoeken reageren overeenkomstig artikel 12, lid 3 AVG.
Indien de deelnemer gebruik wil maken van zijn/haar herroepings- of bezwaarrecht, volstaat een informele kennisgeving per e-mail aan DataProtectionOnline@canda.com. Daarnaast hebben deelnemers het recht een klacht in te dienen bij een toezichthoudende autoriteit indien zij het niet eens zijn met de verwerking van hun gegevens.

10. Vragen of klachten in verband met de actie dienen te worden gericht aan C&A. Contactgegevens zijn te vinden op het Facebook-profiel van C&A.
Het Duitse recht is van toepassing. Rechtsgang is uitgesloten.
11. Indien een bepaling van deze overeenkomst ongeldig is of wordt of indien er sprake is van een lacune, laat dit de geldigheid van de overige bepalingen onverlet. Ongeldige bepalingen worden in onderling overleg vervangen door bepalingen die het doel van de ongeldige bepaling zo dicht mogelijk benaderen.
12. DEZE ACTIE STAAT OP GEEN ENKELE WIJZE IN VERBAND MET FACEBOOK EN WORDT OP GEEN ENKELE WIJZE GESPONSORD, ONDERSTEUND OF GEPRODUCEERD DOOR INSTAGRAM OF TIKTOK. DOOR DEELNAME AAN DEZE ACTIE ONTSLAAN ALLE DEELNEMERS INSTAGRAM EN TIKTOK VAN ENIGE AANSPRAKELIJKHEID IN VERBAND MET DE ACTIE. INSTAGRAM EN TIKTOK ZIJN NIET BESCHIKBAAR ALS CONTACTPUNT VOOR DE ACTIE.
1. The competition is organized by C&A Mode GmbH & Co.KG (in the following “C&A”) with its registered office at Wanheimer Straße 70, 40468 Düsseldorf, VAT number DE 121280555. The competition shall be governed exclusively by these Terms and Conditions.
2. Participants can win a Bose headphone set.The amount of the prize is appr. 260,- Euro.
3. The minimum age for participation is 18 years on the closing date. C&A reserves the right to exclude persons from participation at its own discretion if there are justified reasons, e.g. (a) in the event of manipulation in connection with access to or participation in the competition, (b) in the event of violations of these conditions of participation, (c) in the event of false or misleading information in connection with participation in the competition.
4. The competition begins on 09 April 2026 and ends on 29 April 2026 at 23:59 CET. To participate, participants must either take a photo of themselves wearing a C&A denim look or use the video created in the C&A Mirror Room. The photo or video must be posted in the feed (not as a story) on the participant’s public Instagram and/or TikTok account. The post must include the hashtag #MadeForMoves and tag @ca both in the content and in the caption. Participants must follow C&A on the respective social media platform(s) used for participation for the duration of the competition. Only entries submitted via public social media profiles and in compliance with these requirements will be eligible.The winner(s) will be selected by a jury based on the best outfit and move.
Participation is possible only within the participation period of the respective competition. Participation after the closing date will not be considered. It is strictly forbidden to use multiple e-mail addresses or multiple Instagram and/or TikTok profiles to increase the chances of winning. Participation is free of charge except for the incurring telecommunication costs that have to be borne by the participant.
The winner will be notified via the Instagram/TikTok comments function and must accept the prize in writing within 5 days of being notified, e.g. via Direct Message to C&A. If a winner does not respond within the specified period, their claim to the prize will lapse and C&A will re-draw the prize.
The prize will be awarded exclusively to the winner. Exchanges, collection by the winners or cash payment of the prize are not permitted. Partial cash payment of the prize is also not permitted. Any costs incurred in sending the prize will be borne by C&A. The risk of deterioration and accidental loss passes to the respective winners upon dispatch.
5. To the extent permitted by law, C&A excludes liability for any technical difficulties and the electronic transmission of data affecting the final result of the competition or participation in the competition as well as claims in connection with the processing of the prizes played out. The liability of C&A, C&A's cooperation partners and the persons engaged by them for the execution of the competition and the payment and provision of the prize is limited to cases in which essential contractual obligations have been violated, the fulfilment of which the participant could rely on to a special degree (so-called cardinal obligations). The scope of liability is limited to the foreseeable damage typical for the contract. The exclusion of liability does not apply in the case of deliberate, grossly negligent or malicious behaviour, nor does it apply to personal injury, guarantees or claims under the Product Liability Act.
6. C&A reserves the right to terminate the competition in whole or in part at any time, even without notice. This applies in particular if due to technical (e.g. manipulation) or legal reasons (e.g. prohibition by Facebook) proper execution is not guaranteed.
7. By participating in the competition, the participants confirm that they have read and accepted the conditions of participation and that they agree to the use of their personal data (full name, address, e-mail address, photo, telephone number, date of birth) exclusively for the purposes of the competition and the sending of the prize.

C&A processes the personal data of the participants is a contractual requirement and necessary in order to run the competition, among other things to determine whether the participant is eligible to participate and to determine and notify the winners. If the participant does not provide C&A with the aforementioned data, it is not possible to participate in the competition or to contact C&A regarding a prize notification. Personal data is processed lawfully on the basis of the General Data Protection Regulation (GDPR), namely for the fulfilment of a contract as well as for safeguarding our legitimate interests in the security and integrity of our systems as well as the defence against claims made against us in connection with the registration page and winnings - see Article 6 paragraph 1 letters b), and f) GDPR or § 15 paragraph 3 German Telemedia Act (TMG).
After determination of the respective winner, the personal data processed within the framework of the competition will be deleted within 90 days.
As a matter of principle, the data will not be passed on to third parties, unless the passing on is necessary for the execution of the competition, the dispatch of the prize or the organization and execution of a journey and there is a data protection-legal right of transmission. The data will then be processed by the commissioned service providers within the scope of order processing in accordance with Article 28 GDPR. All contract processors have been carefully selected, support C&A strictly according to instructions and are only granted access to the data of the participants to the extent and for the period required that is necessary for the provision of the services or to the extent to which the participant has agreed to the data processing and use.
According to the GDPR, the participants have the right to request information on their personal data, as well as to demand correction, deletion or at least restriction of the processing of their personal data. The participants also have the right to data transferability. We will respond to such requests within one month at the latest in accordance with Article 12, paragraph 3 of the GDPR.
If the participant wishes to make use of their right of revocation or objection, an informal notification to the e-mail address DataProtectionOnline@canda.com is sufficient. Moreover, the participants are entitled to lodge a complaint with a data protection authority if they do not agree with the processing of their data.

8. Questions or complaints in connection with the competition shall be directed to C&A. Contact information can be found in the C&A Facebook profile.
German law shall apply. Legal recourse is excluded.
9. If a provision of this agreement is or becomes legally invalid or if there is any gap that needs to be filled, the validity of the remainder of the agreement shall not be affected thereby. Invalid provisions shall be replaced by common consent with such provisions which come as close as possible to the intended result of the invalid provision. In the event of gaps such provision shall come into force by common consent which comes as close as possible to the intended result of the agreement, should the matter have been considered in advance.
10. THIS PROMOTION IS NOT RELATED TO FACEBOOK AND IS NOT SPONSORED, SUPPORTED OR ORGANIZED BY INSTAGRAM OR TIKTOK IN ANY WAY. BY PARTICIPATING IN THIS COMPETITION, ALL PARTICIPANTS WILL RELEASE INSTAGRAM OR TIKTOK FROM ANY CLAIMS OR LIABILITY IN CONNECTION WITH THE COMPETITION.
