1. Veranstalter des Gewinnspiels ist die **C&A Mode GmbH & Co. KG** (nachfolgend „C&A“) mit Sitz in der Wanheimer Straße 70, 40468 Düsseldorf, Umsatzsteuer-ID DE 121280555. Für das Gewinnspiel gelten ausschließlich diese Teilnahmebedingungen.
2. Die Teilnehmer können ein Bose-Kopfhörerset gewinnen. Der Wert des Gewinns beträgt ca. 260,- EUR.
3. Das Mindestalter für die Teilnahme beträgt 18 Jahre zum Zeitpunkt des Teilnahmeschlusses. C&A behält sich das Recht vor, Personen nach eigenem Ermessen von der Teilnahme auszuschließen, sofern berechtigte Gründe vorliegen, z. B. (a) bei Manipulationen im Zusammenhang mit dem Zugang zum oder der Teilnahme am Gewinnspiel, (b) bei Verstößen gegen diese Teilnahmebedingungen, (c) bei falschen oder irreführenden Angaben im Zusammenhang mit der Teilnahme am Gewinnspiel.
4. Das Gewinnspiel beginnt am 09. April 2026 und endet am 29. April 2026 um 23:59 Uhr MEZ. Zur Teilnahme müssen die Teilnehmer entweder ein Foto von sich selbst in einem C&A-Denim-Look aufnehmen oder das im C&A Mirror Room erstellte Video verwenden. Das Foto oder Video muss im Feed (nicht als Story) auf dem öffentlichen Instagram- und/oder TikTok-Account des Teilnehmers veröffentlicht werden. Der Beitrag muss den Hashtag #MadeForMoves enthalten und sowohl im Inhalt als auch in der Bildunterschrift @ca taggen. Die Teilnehmer müssen C&A für die Dauer des Gewinnspiels auf der/den für die Teilnahme genutzten Social-Media-Plattform(en) folgen. Teilnahmeberechtigt sind ausschließlich Einsendungen über öffentliche Social-Media-Profile, die diesen Anforderungen entsprechen. Der/die Gewinner wird/werden von einer Jury auf Grundlage des besten Outfits und der besten Bewegung ausgewählt.
Die Teilnahme ist ausschließlich innerhalb des jeweiligen Teilnahmezeitraums möglich. Nach Teilnahmeschluss eingehende Teilnahmen werden nicht berücksichtigt. Es ist strengstens untersagt, mehrere E-Mail-Adressen oder mehrere Instagram- und/oder TikTok-Profile zu verwenden, um die Gewinnchancen zu erhöhen. Die Teilnahme ist kostenlos, abgesehen von gegebenenfalls anfallenden Telekommunikationskosten, die vom Teilnehmer zu tragen sind.
5. Der Gewinner wird über die Kommentar-Funktion von Instagram/TikTok benachrichtigt und muss den Gewinn innerhalb von 5 Tagen nach Benachrichtigung schriftlich annehmen, z. B. per Direktnachricht an C&A. Erfolgt innerhalb dieser Frist keine Rückmeldung, verfällt der Gewinnanspruch und C&A wird den Gewinn neu auslosen.
6. Der Gewinn wird ausschließlich an den Gewinner vergeben. Ein Umtausch, eine Selbstabholung durch den Gewinner oder eine Barauszahlung des Gewinns sind nicht möglich. Eine teilweise Barauszahlung ist ebenfalls ausgeschlossen. Etwaige Versandkosten für den Gewinn trägt C&A. Die Gefahr des zufälligen Untergangs und der Verschlechterung geht mit dem Versand auf den Gewinner über.
7. Soweit gesetzlich zulässig, schließt C&A die Haftung für technische Störungen sowie für die elektronische Datenübertragung aus, die das Endergebnis des Gewinnspiels oder die Teilnahme daran beeinflussen, ebenso wie für Ansprüche im Zusammenhang mit der Abwicklung der ausgespielten Gewinne. Die Haftung von C&A, ihren Kooperationspartnern sowie der von ihnen mit der Durchführung des Gewinnspiels sowie der Auszahlung und Bereitstellung des Gewinns beauftragten Personen ist auf Fälle beschränkt, in denen wesentliche Vertragspflichten verletzt wurden, auf deren Erfüllung der Teilnehmer in besonderem Maße vertrauen durfte (sog. Kardinalpflichten). Der Haftungsumfang ist auf den vorhersehbaren, vertragstypischen Schaden begrenzt. Der Haftungsausschluss gilt nicht bei Vorsatz, grober Fahrlässigkeit oder Arglist sowie bei Verletzung von Leben, Körper oder Gesundheit, bei Garantien oder Ansprüchen nach dem Produkthaftungsgesetz.
8. C&A behält sich das Recht vor, das Gewinnspiel jederzeit ganz oder teilweise, auch ohne vorherige Ankündigung, zu beenden. Dies gilt insbesondere, wenn aus technischen (z. B. Manipulation) oder rechtlichen Gründen (z. B. Verbot durch Facebook) eine ordnungsgemäße Durchführung nicht gewährleistet werden kann.
9. Mit der Teilnahme am Gewinnspiel bestätigen die Teilnehmer, dass sie die Teilnahmebedingungen gelesen und akzeptiert haben und erklären sich mit der Nutzung ihrer personenbezogenen Daten (vollständiger Name, Adresse, E-Mail-Adresse, Foto, Telefonnummer, Geburtsdatum) ausschließlich zum Zwecke der Durchführung des Gewinnspiels und des Versands des Gewinns einverstanden.

Die Verarbeitung der personenbezogenen Daten der Teilnehmer durch C&A ist eine vertragliche Erforderlichkeit und notwendig zur Durchführung des Gewinnspiels, unter anderem zur Prüfung der Teilnahmeberechtigung sowie zur Ermittlung und Benachrichtigung der Gewinner. Sofern der Teilnehmer C&A die vorgenannten Daten nicht zur Verfügung stellt, ist eine Teilnahme am Gewinnspiel oder eine Kontaktaufnahme im Zusammenhang mit einer Gewinnbenachrichtigung nicht möglich. Die Verarbeitung der personenbezogenen Daten erfolgt rechtmäßig auf Grundlage der Datenschutz-Grundverordnung (DSGVO), insbesondere zur Erfüllung eines Vertrags sowie zur Wahrung unserer berechtigten Interessen an der Sicherheit und Integrität unserer Systeme sowie der Abwehr von Ansprüchen im Zusammenhang mit der Registrierungsseite und Gewinnen – siehe Artikel 6 Absatz 1 Buchstaben b) und f) DSGVO bzw. § 15 Absatz 3 Telemediengesetz (TMG).
Nach Ermittlung des jeweiligen Gewinners werden die im Rahmen des Gewinnspiels verarbeiteten personenbezogenen Daten innerhalb von 90 Tagen gelöscht.
Grundsätzlich werden die Daten nicht an Dritte weitergegeben, es sei denn, die Weitergabe ist zur Durchführung des Gewinnspiels, zum Versand des Gewinns oder zur Organisation und Durchführung einer Reise erforderlich und es besteht eine datenschutzrechtliche Übermittlungsbefugnis. Die Daten werden in diesem Fall von den beauftragten Dienstleistern im Rahmen der Auftragsverarbeitung gemäß Artikel 28 DSGVO verarbeitet.
Gemäß DSGVO haben die Teilnehmer das Recht, Auskunft über ihre personenbezogenen Daten zu verlangen sowie deren Berichtigung, Löschung oder zumindest Einschränkung der Verarbeitung zu fordern. Darüber hinaus haben die Teilnehmer das Recht auf Datenübertragbarkeit. Wir werden auf entsprechende Anfragen spätestens innerhalb eines Monats gemäß Artikel 12 Absatz 3 DSGVO reagieren.
Möchte der Teilnehmer von seinem Widerrufs- oder Widerspruchsrecht Gebrauch machen, genügt eine formlose Mitteilung an die E-Mail-Adresse DataProtectionOnline@canda.com. Darüber hinaus haben die Teilnehmer das Recht, sich bei einer Datenschutzaufsichtsbehörde zu beschweren, sofern sie mit der Verarbeitung ihrer Daten nicht einverstanden sind.

10. Fragen oder Beschwerden im Zusammenhang mit dem Gewinnspiel sind an C&A zu richten. Die Kontaktdaten sind im Facebook-Profil von C&A zu finden.
Es gilt deutsches Recht. Der Rechtsweg ist ausgeschlossen.
11. Sollte eine Bestimmung dieser Vereinbarung unwirksam sein oder werden oder sollte eine Regelungslücke bestehen, bleibt die Wirksamkeit der übrigen Bestimmungen hiervon unberührt. Unwirksame Bestimmungen sind einvernehmlich durch solche zu ersetzen, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung am nächsten kommen.
12. DIESE AKTION STEHT IN KEINER VERBINDUNG ZU FACEBOOK UND WIRD IN KEINER WEISE VON INSTAGRAM ODER TIKTOK GESPONSERT, UNTERSTÜTZT ODER ORGANISIERT. DURCH DIE TEILNAHME AN DIESEM GEWINNSPIEL STELLEN ALLE TEILNEHMER INSTAGRAM ODER TIKTOK VON JEGLICHEN ANSPRÜCHEN ODER HAFTUNGEN IM ZUSAMMENHANG MIT DEM GEWINNSPIEL FREI. 1. The competition is organized by C&A Mode GmbH & Co.KG (in the following “C&A”) with its registered office at Wanheimer Straße 70, 40468 Düsseldorf, VAT number DE 121280555. The competition shall be governed exclusively by these Terms and Conditions.
2. Participants can win a Bose headphone set.The amount of the prize is appr. 260,- Euro.
3. The minimum age for participation is 18 years on the closing date. C&A reserves the right to exclude persons from participation at its own discretion if there are justified reasons, e.g. (a) in the event of manipulation in connection with access to or participation in the competition, (b) in the event of violations of these conditions of participation, (c) in the event of false or misleading information in connection with participation in the competition.
4. The competition begins on 09 April 2026 and ends on 29 April 2026 at 23:59 CET. To participate, participants must either take a photo of themselves wearing a C&A denim look or use the video created in the C&A Mirror Room. The photo or video must be posted in the feed (not as a story) on the participant’s public Instagram and/or TikTok account. The post must include the hashtag #MadeForMoves and tag @ca both in the content and in the caption. Participants must follow C&A on the respective social media platform(s) used for participation for the duration of the competition. Only entries submitted via public social media profiles and in compliance with these requirements will be eligible.The winner(s) will be selected by a jury based on the best outfit and move.
Participation is possible only within the participation period of the respective competition. Participation after the closing date will not be considered. It is strictly forbidden to use multiple e-mail addresses or multiple Instagram and/or TikTok profiles to increase the chances of winning. Participation is free of charge except for the incurring telecommunication costs that have to be borne by the participant.
The winner will be notified via the Instagram/TikTok comments function and must accept the prize in writing within 5 days of being notified, e.g. via Direct Message to C&A. If a winner does not respond within the specified period, their claim to the prize will lapse and C&A will re-draw the prize.
The prize will be awarded exclusively to the winner. Exchanges, collection by the winners or cash payment of the prize are not permitted. Partial cash payment of the prize is also not permitted. Any costs incurred in sending the prize will be borne by C&A. The risk of deterioration and accidental loss passes to the respective winners upon dispatch.
5. To the extent permitted by law, C&A excludes liability for any technical difficulties and the electronic transmission of data affecting the final result of the competition or participation in the competition as well as claims in connection with the processing of the prizes played out. The liability of C&A, C&A's cooperation partners and the persons engaged by them for the execution of the competition and the payment and provision of the prize is limited to cases in which essential contractual obligations have been violated, the fulfilment of which the participant could rely on to a special degree (so-called cardinal obligations). The scope of liability is limited to the foreseeable damage typical for the contract. The exclusion of liability does not apply in the case of deliberate, grossly negligent or malicious behaviour, nor does it apply to personal injury, guarantees or claims under the Product Liability Act.
6. C&A reserves the right to terminate the competition in whole or in part at any time, even without notice. This applies in particular if due to technical (e.g. manipulation) or legal reasons (e.g. prohibition by Facebook) proper execution is not guaranteed.
7. By participating in the competition, the participants confirm that they have read and accepted the conditions of participation and that they agree to the use of their personal data (full name, address, e-mail address, photo, telephone number, date of birth) exclusively for the purposes of the competition and the sending of the prize.

C&A processes the personal data of the participants is a contractual requirement and necessary in order to run the competition, among other things to determine whether the participant is eligible to participate and to determine and notify the winners. If the participant does not provide C&A with the aforementioned data, it is not possible to participate in the competition or to contact C&A regarding a prize notification. Personal data is processed lawfully on the basis of the General Data Protection Regulation (GDPR), namely for the fulfilment of a contract as well as for safeguarding our legitimate interests in the security and integrity of our systems as well as the defence against claims made against us in connection with the registration page and winnings - see Article 6 paragraph 1 letters b), and f) GDPR or § 15 paragraph 3 German Telemedia Act (TMG).
After determination of the respective winner, the personal data processed within the framework of the competition will be deleted within 90 days.
As a matter of principle, the data will not be passed on to third parties, unless the passing on is necessary for the execution of the competition, the dispatch of the prize or the organization and execution of a journey and there is a data protection-legal right of transmission. The data will then be processed by the commissioned service providers within the scope of order processing in accordance with Article 28 GDPR. All contract processors have been carefully selected, support C&A strictly according to instructions and are only granted access to the data of the participants to the extent and for the period required that is necessary for the provision of the services or to the extent to which the participant has agreed to the data processing and use.
According to the GDPR, the participants have the right to request information on their personal data, as well as to demand correction, deletion or at least restriction of the processing of their personal data. The participants also have the right to data transferability. We will respond to such requests within one month at the latest in accordance with Article 12, paragraph 3 of the GDPR.
If the participant wishes to make use of their right of revocation or objection, an informal notification to the e-mail address DataProtectionOnline@canda.com is sufficient. Moreover, the participants are entitled to lodge a complaint with a data protection authority if they do not agree with the processing of their data.

8. Questions or complaints in connection with the competition shall be directed to C&A. Contact information can be found in the C&A Facebook profile.
German law shall apply. Legal recourse is excluded.
9. If a provision of this agreement is or becomes legally invalid or if there is any gap that needs to be filled, the validity of the remainder of the agreement shall not be affected thereby. Invalid provisions shall be replaced by common consent with such provisions which come as close as possible to the intended result of the invalid provision. In the event of gaps such provision shall come into force by common consent which comes as close as possible to the intended result of the agreement, should the matter have been considered in advance.
